Preamble

The e-commerce website petitejupenoire.fr (hereinafter ” the Site ”) is an online shopping platform accessible via the Internet, open to any user of this network. It is operated by the company AIRAMI (hereinafter “AIRAMI“), a Simplified Joint Stock Company with a capital of 200 Euros, headquartered at 77 terrasse de l’université, 92000 Nanterre, registered with the Nanterre Trade and Companies Register under the number 919 841 239, VAT number FR 23 919 841 239.

The Site allows AIRAMI to offer its products (hereinafter “the Products”) for sale to non-professional buyers who are consumers (hereinafter “the Customers”).

These General Terms and Conditions of Sale (hereinafter referred to as “GTC“) aim to define the conditions under which the sales of the Products offered by AIRAMI via the Site are conducted. Any order of a Product offered on the Site implies the full and complete adherence of the Customer to these GTC.

AIRAMI reserves the right to modify these GTC at any time, by publishing a new version on the Site. In the event of modification, the GTC applicable are those in force at the time of placing the order.

These GTC are solely in French, located at the bottom of the Site’s page, and are permanently accessible at the following address: https://petitejupenoire.fr/cgv/.They are provided in a digital format allowing for printing, enabling the Customer to save them.

These GTC and the order summary sent to the Customer constitute a contractual set summarizing the entirety of the agreements between the parties.

It is specified that the purchase of Products on the Site is reserved for non-trading individuals, as consumers, who are over 18 years old and have full legal capacity.

The site does not allow the purchase of products for resale purposes.

Article 1 – Products

In accordance with article L. 111-1 of the Consumer Code, the company AIRAMI presents on the Site the Products for sale and their characteristics. Before placing the final order, the Customer has the opportunity to know the essential characteristics of the Products he wishes to purchase.

The essential characteristics of the Products are presented on the Site in each of the product pages. The information corresponding to the Products, as well as their photos, may be partially derived from data transmitted to AIRAMI by suppliers. They are given for informational purposes only. In the event of an error, AIRAMI cannot be held responsible. We undertake to make our best efforts to correct any errors or omissions reported to us as quickly as possible.

The in-stock offers presented by the AIRAMI company are only valid while stocks last. For each Product, the note indicating the stock is provided for information purposes only. It is updated at the time of validation of each order and therefore does not take into account orders currently being established. It is therefore possible that the Product ordered is no longer available.

Article 2 – Price

2.1 Selling Price

The sales prices on the Product pages on the Site are indicated in Euros (€) and all taxes included (TTC), excluding shipping and processing costs for your order. In the event of a change in the VAT rate, the price will be automatically modified from the date of application of the new rate.

AIRAMI reserves the right to modify its prices at any time, it being understood that the invoicing of the Products will be based on the prices in force at the time of registration of the Order or Pre-order.

Orders are payable in Euros only.

Payment of the entire price must be made when placing the Order.

The Products remain the property of AIRAMI until full payment of the price by the Customer.

Products on promotion will be indicated by a “Sale” sticker or by a crossed-out Price. Promotions are valid while stocks last at the time of ordering and during the display period.

2.2 French VAT & non-EU Customers

We apply a reduction in French VAT of 20% for our customers who reside outside the European Union, such as Switzerland etc.

When a non-EU Customer finalizes an order (the delivery address outside the EU is entered), the system automatically adjusts the VAT amount, leaving a zero amount for French VAT.

Article 3 – Order

The Customer can select one or more products by clicking on the “Add to cart” button to place an order. At any time, the Customer can perform the following actions:

  • Check the number of products in the cart and obtain detailed information on each of them by clicking on “Shopping cart”.
  • Validate the order by clicking on “Place order”.
  • Create an account or log in:

If this is a new Customer, then it is required to provide the necessary information to create a customer account. The registration form must be completed accurately, including personal information (surname, first name, postal address, telephone number, etc.) and identification information such as email address and a personal and confidential password, which will be used subsequently to access the Site.

Any Customer who already has a customer account must identify themselves by clicking on « Returning customer? Click here to login » and entering the registered email and password.

  • Finalize the order, after reading and accepting the GTC, by clicking on “Place order”.

It is mandatory to provide personal information collected in the context of distance selling, as it is necessary to process and deliver orders, as well as to issue invoices. This information is strictly confidential.

At the end of payment, any Order will be confirmed to the Customer by an email summarizing it (products, price, quantity, etc.).

The summary of the Order, as well as the corresponding invoice, will also be accessible on the Site in your account area, the “Orders” section.

If the Product is in stock, the Order will be executed at the latest within 7 days from the day following that on which the Customer placed their Order. In the event of unavailability of the Product ordered, in particular due to suppliers, the Customer will be informed as soon as possible and will have the possibility of canceling the Order.

From the cancellation of the Order, AIRAMI will reimburse the Customer within fourteen (14) days.

AIRAMI reserves the right to cancel or refuse any Order from a Customer with whom there is a dispute.

Article 4 – Payment

Full payment must be made at the time of ordering, and no partial payments will be considered as deposits.

We do not accept cash on delivery shipments for any reason.

AIRAMI remains owner of the Product until the Customer has paid the total price.

The Customer can pay for his order by credit card: Visa, Mastercard, American Express.

For payment by credit card, the Customer must provide their bank card number, the expiration date and the cryptogram located on the back of the card. In order to guarantee the security of online payments, the company Mollie provides the Customer with a dedicated space which ensures the security and recording of the payment order and the security of the payment itself. Consequently, the Customer explicitly acknowledges that the transmission of his bank card number to the company AIRAMI via the company Mollie constitutes authorization to debit his account for the products ordered.

Regardless of the payment method used, the company AIRAMI covers occasional bank charges linked to the payment, as long as they do not exceed the management fees invoiced by the company Mollie. All payments are processed through Mollie. Any other costs, whatever the reason, will be invoiced to the Customer.

AIRAMI reserves the right to suspend or cancel any order and delivery if authorization for payment by credit card is refused by officially accredited organizations or in the event of non-payment. In addition, AIRAMI may refuse to honor an order or make a delivery for a customer who has not paid in full a previous order or with whom a payment dispute is in progress.

AIRAMI’s computer records, kept in reasonable security conditions in its computer systems, will be considered as proof of communications, orders and payments between the parties. The purchase orders and invoices are stored in a durable and reliable format that can be provided as evidence.

Article 5 – Invoice

Once the Order is validated and paid, a confirmation email is automatically sent to the Customer to the email address provided when ordering. If the email cannot be found in the primary inbox, please check the “Spam” folder.

The invoice can be viewed by logging into your account in the “Orders” section. Please note that the paper invoice will not be included in the package sent to the Customer.

Article 6 – Delivery

6.1 Delivery Rates

For any order in mainland France, Belgium, Monaco, Germany, Luxembourg, the Netherlands, Austria, Italy, the United Kingdom (UK), and Ireland, PetiteJupeNoire offers free shipping, regardless of the number of items or the total amount of your order!

A flat rate of 10 euros is applied for delivery to Sweden, Denmark, the Czech Republic, Slovakia, Slovenia, Poland, and Switzerland.

A flat rate of 15 euros is applied for delivery to the United States (USA), Canada, Finland, Bulgaria, Croatia, and Turkey.

6.2 Carrier

The delivery of remotely sold Products is ensured by the carrier of our choice.

6.3 Place of Delivery

The Products are shipped to the delivery address indicated by the Customer when ordering. The delivery address must be the Customer’s residential address or that of any other individual of their choice, if clearly specified during the Order. Delivery cannot be made to hotels or to postal boxes.

6.4 Processing Times

Any order registered on the Site will be processed within 1 to 4 working day(s).

Orders are processed and shipped from Monday to Friday. Orders placed on Saturday or Sunday will be processed on the following Monday. Those placed on a public holiday will be processed on the next working day.

6.5 Delivery Times

The (approximate) delivery times are from 2 to 15 days from the shipping date.

Products will be shipped from different locations based on where AIRAMI has them stocked. All products from petitejupenoire.fr are manufactured and stored in countries like France, Mongolia, and China.

AIRAMI will strive to provide you with an approximate date when the Products will be ready for pickup or delivery, and in any case, AIRAMI will deliver the Products within 30 days unless otherwise specified. If AIRAMI becomes aware that the delivery date might be delayed, you will be informed as soon as possible, and a revised date will be provided. AIRAMI may deliver the Products before the stated delivery date by giving you reasonable notice.

AIRAMI cannot be held responsible for any delivery delays caused by circumstances beyond its control or due to force majeure. Delivery delays cannot lead to any penalties or compensation, nor justify the cancellation of the order.

To ensure these timeframes are met, the Customer must ensure that accurate and complete information regarding the delivery address is provided (such as street number, building, staircase, access codes, intercom names and/or numbers, etc.). In case of errors in the Customer’s address details, AIRAMI cannot be held responsible for the inability to deliver the ordered item(s).

The Customer should make all necessary arrangements to receive the Products as soon as they are available for delivery.

If the Customer requests our delivery service provider to leave the Products in a secure location, the Customer is deemed to accept full responsibility for the Products if their instructions are followed.

If the Customer fails to take delivery of the Products or provide adequate delivery instructions (for example, any errors in the Customer’s address format or otherwise) at the time indicated for delivery, AIRAMI reserves the right to store the Products until actual delivery and charge the Customer reasonable costs (including insurance) for storage or subsequent delivery fees.

6.5 Customs

Within the EU we ship all goods duty free, so no taxes need to be paid locally.
Outside the EU, our parcels generally fall below the thresholds for local taxes. However, in very rare cases, customs duties and fees may be requested for delivery. Petitejupenoire.fr is not responsible for these fees. We recommend contacting your local customs office for further information.

In the event of a product return and refund request, it’s important to note that any customs fees possibly paid by the Customer are not covered by AIRAMI. These fees remain the sole responsibility of the Customer and will not be reimbursed by AIRAMI during the return and refund process.

Article 7 – Receipt of the Order

Delivery is considered completed as soon as the carrier hands over the products to the Customer, confirmed by the carrier’s tracking system.

The Customer undertakes to report, through any means, any reservations or any damage of the package or the Products (open package, missing products, damaged products, products not in conformity with the order, etc.) to the carrier and to AIRAMI within 48 hours following receipt of the package, by sending an email to contact@petitejupenoire.fr. Please ensure to inspect your Products upon receipt. Please ensure to inspect your Products upon receipt.

Any claim made beyond this period will be deemed inadmissible, and AIRAMI cannot be held responsible.

The risks of loss or damage to the products are transferred to the Customer after delivery and receipt of the products.

AIRAMI reserves the right to request the Customer to return any non-conforming or damaged product.

If the Customer makes excessive or abusive returns, AIRAMI may refuse to process the Customer’s future orders.

Article 8 – Right of Withdrawal, Returns, Exchanges

8.1 Withdrawal Period

The Customer has a period of 14 (fourteen) days from the date of receipt of the order to request the return of the Product(s).

The withdrawal period expires fourteen days from the day of delivery, specifying that if the period ends on a Saturday, Sunday, or a public holiday, it is extended until the next working day. Delivery here refers to the actual receipt of the Product by the Customer or by a third party designated by the Customer, other than the carrier.

8.2 Withdrawal Form

Any return must be declared by the Customer to AIRAMI via email at contact@petitejupenoire.fr, by sending the completed Withdrawal Form below:

8.3 Condition of Products for Returns

All Products can be subject to withdrawal and return, provided they are in their original condition, unworn, unwashed, free from odors (perfume, smoke, or otherwise), with their packaging and labels.

AIRAMI would like to bring to the Customer’s attention that any signs of use (including makeup or lipstick marks, perfume odors, cigarette odors, etc.) on a Product make it unsellable for AIRAMI. To compensate for this loss, an indemnity equivalent to the price of the Product will be claimed from you. In such a scenario, the Product will be returned to you, and AIRAMI will retain the full amount. The re-shipping costs will also be borne by the Customer.

8.4 Return Address

The Customer must return the Product(s) to the following address:

If the item is not returned by the Customer within 14 (fourteen) days after making the request, the return or exchange is considered canceled, and the Customer must keep the product.

8.5 Return Costs

The return is made at the Customer’s risk. It is the Customer’s responsibility to keep all proof of return.

Return costs are the responsibility of the Customer and cannot be refunded.

The exception is made only in the event of a defective product or one that does not conform to your order.

Upon receiving a return, if we find that the products sent are indeed not in line with your order or are defective, the return costs will be refunded to you, upon proof and based on the Colissimo R1 recommended shipping rate with signature. Shipping packaging will not be refunded, so we encourage you to keep and reuse the original packaging you received upon delivery.

8.6 Refund

In the case of a return, the customer will be refunded within a maximum period of 14 (fourteen) days from its receipt by AIRAMI. The refund will be processed using the same payment method as the initial order (credited amount refunded to the bank account).

For the return of one or more product(s) sold as part of a promotional offer and if the conditions of that offer are no longer met, AIRAMI will proceed with the refund of the amount of the product(s) minus the promotional offer amount.

8.7 Exchange

We do not offer exchanges.

If you desire a different Product (different size or color, for instance), you need to place another order and return the Product that doesn’t suit you.

Article 9 – Personal Data

AIRAMI collects personal information necessary to process orders and communicate with the customer. This data is only used by AIRAMI and/or its service providers to manage the order. The information collected is strictly confidential and when it is necessary for the management of the order, it is marked with an asterisk (*).

If necessary to defend the rights of AIRAMI, its employees, customers or any other person, AIRAMI may communicate personal data to authorized organizations and authorities. AIRAMI undertakes to take all necessary measures to ensure the security of files and the protection of computer systems, in order to prevent any distortion, damage or unauthorized access to the customer’s personal information.

The Customer’s personal information is stored with HOSTINGER, the host of the Site. The contact details of this host are available in the “Legal Notices” section of the Site.

In accordance with the “Information Technology and Freedom” law of January 6, 1978, the Customer has the right to access, rectify, modify, and delete their personal data.

The customer can exercise this right by sending a registered letter with acknowledgment of receipt to the address: AIRAMI, 77 terrasse de l’Université, 92000, Nanterre, France or by email (contact@petitejupenoire.fr) providing their name, first name, email, and postal address..

The Customer can also modify their personal information by accessing their “My account” area using their email address and password.

Article 10 – Security

The petitejupenoire.fr Site has been secured with an SSL encryption system, and additional scrambling and encryption measures have been implemented to effectively protect all sensitive payment-related information.

Article 11 – Warranty and Liability

Subject to normal use and compliance with maintenance instructions, all our products benefit from the legal warranty.

By placing an order on our Site, the Customer acknowledges and accepts the procedures in effect on the Internet, including technical performance, response times, risks of interruption, virus contamination, and any other risks associated with network use.

Therefore, AIRAMI cannot be held responsible for direct or indirect damages resulting from the misuse of the computer, internet access, maintenance, server malfunction, phone line, or any other technical connection, as the Customer’s connection to the Site is at their own responsibility.

Article 12 – Force Majeure

AIRAMI cannot be held responsible for the total or partial non-performance of its obligations towards the Customer in the event of force majeure, as defined by the law, which prevents or delays the execution of the order.

In such a case, AIRAMI will inform the Customer of the event within 14 (fourteen) days of its occurrence, by email.

If the event constituting a force majeure persists beyond one month, the order will be canceled, and AIRAMI will proceed with a refund, if applicable, within a maximum period of 30 (thirty) days.

Article 13 – Intellectual Property

AIRAMI owns all intellectual property rights and associated derivative rights related to the petitejupenoire.fr platform, protected worldwide.

Users can freely consult the Site’s data, provided they respect the intellectual property rights as defined in these GTC. AIRAMI will strive to regularly update the data whenever possible.

No clause in these GTC can be interpreted as conferring, expressly or implicitly, any right to the Customer (via a license or otherwise) over the names, trademarks, symbols, logos, and other distinctive signs of AIRAMI, or over any other intellectual property right owned by AIRAMI.

Article 14 – Applicable Law – Dispute Resolution

If any provision of these GTC is declared null, illegal, or unenforceable by a court decision, the other provisions will remain in effect.

The Customer is informed that in the event of a dispute, they can resort to alternative dispute resolution methods (such as conciliation). In the absence of resolution through these means within fifteen (15) days, any dispute concerning the existence, validity, interpretation, execution, and performance of these GTC (or any of its clauses) will be subject to he exclusive jurisdiction of the courts in the jurisdiction of the Seller’s headquarters.

Disputes arising regarding the validity, interpretation, execution, non-performance, interruption, or termination of these GTC, or even the abrupt termination of established business relationships, will initially be submitted to conciliation between the Parties. This procedure is confidential. In case of dispute or claim, the Customer shall first address AIRAMI to seek an amicable solution.

In this scenario, a conciliator (a third party to the contract) will be jointly appointed by the Parties. The conciliation will be conducted before a single conciliator. In case of disagreement on the choice of the conciliator, the respective lawyers of the Parties will select a neutral conciliator in their mutual interest. The conciliation attempt will be made in good faith, and the Parties agree to meet at least once under the guidance of the conciliator. Unless otherwise agreed, the conciliation process shall not exceed one (1) month from its initiation. Conciliation costs will be equally shared between the Parties. Each Party will bear the costs of their respective lawyers in the context of the conciliation. The Parties agree that any agreement resulting from the conciliation will be recorded in writing, signed by them under the supervision of the conciliator, and will resolve the dispute. If the legal action of either Party is subject to a limitation period likely to expire during the conciliation, that Party may suspend the prescription by any legal means while suspending the procedure until the end of the conciliation. Any dispute relating to the existence, validity, interpretation, execution, and performance of these GTC (or any of its clauses) will be submitted to the exclusive jurisdiction of the Commercial Court of Nanterre, to which the Parties attribute exclusive competence.
